To the Editor: 

Please check your facts and do your diligence. There is no Right to Farm ordinance in Kent. 

In addition, the Planning and Zoning Commission had an updated conversation about this at its meeting last Thursday. The Protection of Farms and Farmers from Nuisance Claims Ordinance does not confer any rights; it shields those farming in accordance with zoning from complaints made by neighbors. In other words, zoning decides if it’s farming. If it is, there can be no nuisance claim. 

The ordinance only applies to farming though, it doesn’t apply to activities that are not farming and can’t be used to argue that activities outside of what is permitted by Zoning are protected as farming.

Thank you for correcting the error, which is important given the historical misinterpretation of the purpose and use of the ordinance.
